These Terms of Use ("Terms") govern your use of dpesedu.com and the products and services offered by Dozzi Performance Education Systems LLC ("DPES," "we," "us," or "our"). By using the Site or purchasing from us, you agree to these Terms. If you do not agree, do not use the Site.

Our services

DPES provides standards-aligned strength and conditioning curriculum, assessment materials, templates, and professional consultations for educators, coaches, and schools.

Intellectual property

All content on the Site and in our products - including curriculum, rubrics, templates, text, graphics, and design - is owned by DPES or its licensors and is protected by copyright and other laws. You may not copy, reproduce, distribute, or create derivative works from it except as expressly allowed by these Terms or with our written permission.

License to use purchased materials

When you purchase a product, DPES grants you a limited, non-exclusive, non-transferable license to use it for your own teaching within a single classroom or program. You may not share, resell, sublicense, publicly post, or redistribute the materials, in whole or in part, to other teachers, schools, websites, or file-sharing services. Unauthorized sharing is a violation of these Terms and of copyright law, and we may pursue removal under the DMCA and other remedies. District- or school-wide licensing is available - contact us.

Purchases, pricing, and refunds

Prices are shown at the point of sale and may change. Payments are handled by our third-party payment provider. Because our products are digital and delivered immediately, all sales are final. If you have a problem with an order, email us and we will try to make it right.

Consultations and bookings

Consultations are scheduled through our booking link. Please give reasonable notice to reschedule. Consultations provide professional guidance based on your situation; they do not create any ongoing obligation unless separately agreed in writing.

Acceptable use

You agree not to misuse the Site, attempt to gain unauthorized access, interfere with its operation, or use it for any unlawful purpose.

Important disclaimer - educational use only

Our curriculum and materials are professional teaching resources intended to be implemented by qualified educators and coaches using appropriate supervision, screening, and safety practices. They are not medical, health, or individual training advice, and they are not a substitute for the judgment of a qualified professional. Strength and conditioning activities carry inherent risks. You are responsible for ensuring that any program is appropriate for your participants, your setting, and your local policies, and for supervising it safely. To the fullest extent permitted by law, DPES is not responsible for injuries or outcomes resulting from how the materials are implemented.

Limitation of liability

To the fullest extent permitted by law, DPES and its owner will not be liable for any indirect, incidental, or consequential damages arising from your use of the Site, our products, or our services. Our total liability for any claim will not exceed the amount you paid us for the product or service giving rise to the claim. The Site and products are provided "as is," without warranties of any kind.

Indemnification

You agree to indemnify and hold DPES harmless from claims arising out of your use of the Site or products or your violation of these Terms.

Third-party services

The Site relies on third-party services (such as hosting, payments, and scheduling). Your use of those services may also be subject to their own terms.
